On January 21, according to media reports, LONGi Green Energy (601012. SH, stock price 14.8 yuan, market value 112.16 billion yuan) countersued JinkoSolar (688223.SH, stock price 6.25 yuan, market value 62.533 billion yuan) patent infringement in the United States, and the related technology involved in the lawsuit is TOPCon (tunneling oxide passivation contact technology).
According to a previous report by the "Daily Economic News", on January 3, Shangrao Xinyuan Yuedong Technology Development Co., Ltd., which is 100% owned by JinkoSolar, sued two companies, including LONGi Green Energy, demanding that they immediately stop infringing on relevant invention patent rights and compensate for economic losses, and the case has been officially accepted by the Intermediate People's Court of Nanchang City, Jiangxi Province, and the trial time is February 13.
On January 6, LONGi replied to reporters that it had paid attention to the media information about the so-called patent infringement "sued" by JinkoSolar, but had not yet received the relevant legal documents on the matter. It also said that the company is one of the enterprises with the largest number of patents in the photovoltaic field, has a relatively complete layout in various technical fields, and also respects the intellectual property rights of other companies. The company will actively investigate and respond, and if necessary, it will also file counterclaims against TOPCon and other technical products.
On January 21, a person in the photovoltaic industry confirmed to reporters the news that LONGi Green Energy countersued JinkoSolar, and said that foreign intellectual property protection is very strict, and if LONGi Green Energy succeeds in counterclaiming, it may have an impact on JinkoSolar's production and sales of TOPCon modules in the United States.
According to JinkoSolar's 2024 Q3 report, from January to September 2024, the company's total PV product shipments were 73.13GW, of which module shipments were 67.65W, with N-type modules accounting for about 85%. According to JinkoSolar, the 2GW module production capacity in the United States is expected to complete the ramp-up by the end of 2024 and is expected to increase in 2025.
On the afternoon of January 21, the reporter called JinkoSolar, but the phone was not answered. The reporter also contacted JinkoSolar's internal staff through WeChat to try to verify the above news, but there was no response as of press time.
