Qualcomm Notches Another Win Over Apple, Gets Certain iPhones Banned in Germany

(Yicai Global) Dec. 21 -- A Munich court has announced a Germany-wide ban on imports of certain iPhone handsets after a patent infringement lawsuit by Qualcomm, securing a second win for the chipmaker after it got multiple Apple phones temporarily banned in China.

The court ruled that Apple had infringed on Qualcomm's intellectual property rights relating to reduced power consumption in smartphones, and put in place a permanent ban on the iPhone 7, 8 and other handsets. The sanction prevents Apple units based in the European Union or United States from importing the models in question or selling them in Germany.

Apple has said it plans to appeal the decision, which according to Judge Matthias Zigann means the ruling will not take effect immediately. The phonemaker also said it would stop selling iPhone 7s and 8s at 15 retail stores in Germany during the appeal process, but will continue to sell the XS, XS Max and XR.

The verdict is the second win for Qualcomm in recent lawsuits against Apple, after a court in China's Fujian province placed a temporary nationwide ban on the sale of the iPhone 6S, 6S Plus, 7, 7 Plus, 8, 8 Plus and X, also for patent infringement. Apple has continued to sell those handsets and says that as the Qualcomm technology is no longer used in later versions of iOS, the iPhone's operating system, by updating its phones it is not violating the chipmaker's rights.
