China Files WTO Complaint Against US, EU Over 'Subrogate Country' Label in Anti-Dumping Cases

(Yicai Global) Dec. 13 -- China has lodged a complaint with the World Trade Organization (WTO) against the European Union (EU) and the United States of America (US) for their continued application of the 'subrogate country' treatment of China in anti-dumping investigations, to safeguard the country's legitimate rights and interests, as well as uphold the solemnity of world trade rules.

The US and the EU have thus far failed to fulfill their obligations as WTO members and their resort to the 'subrogate country' subterfuge has artificially raised anti-dumping rates for Chinese companies and grievously impacted exports and employment in relevant domestic industries, a spokesman for China's commerce ministry said yesterday.

As a transitional arrangement for China's accession to the WTO, the 15th article of the protocol on its accession allows other WTO members to extend 'subrogate country' treatment in anti-dumping investigations against China, but expressly mandates that such provisions shall expire 15 years after the date of China's accession to the WTO -- Dec. 11, 2016.
