CFDA Drafts Law Allowing It to Slap 10-Year Industry Ban on Drug Data Fraudsters CFDA Drafts Law Allowing It to Slap 10-Year Industry Ban on Drug Data Fraudsters

(Yicai Global) Oct. 26 -- The China Food and Drug Administration has published a draft of amendments to the country's Drug Administration Law and opened it up to public comment.

Under the draft, people directly responsible for falsifying drug data at medical institutions and drugmakers will be suspended from the pharmaceutical industry for ten years. Those who face criminal punishment will be barred for life. The amendments also cancel good manufacturing practice and good supply certifications.

For illegal acts or gross negligence, the person in charge and those directly responsible for the issue will be fined an amount equivalent to at least 30 percent of their income the previous year.

According to the judicial interpretation issued by the Supreme People's Court and Supreme People's Procuratorate in August, if drug registration applicants obtain approval by falsifying non-clinical research or clinical trial reports, the individuals concerned can be convicted of a crime and will face punishment.
