AT&M Denies Being Accused of Spoiling Trade Secrets in Metglas, Hitachi's Section 337 Complaint AT&M Denies Being Accused of Spoiling Trade Secrets in Metglas, Hitachi's Section 337 Complaint

(Yicai Global) Sept. 22 -- Advanced Technology & Materials Co. [SHE:000969], or AT&M, is not a part of US-based Metglas Inc. and Japanese Hitachi Metals Ltd.'s lawsuit against Chinese firms for infringing on commercial secrets about amorphous metal strips, the Shenzhen-listed firm said in a statement on Sept. 21.

AT&M and its parent, China Iron & Steel Research Institute Group, are both pioneers and developers of China's amorphous alloy strip technologies, the company said. Over four decades of innovation, breakthroughs and investments, the two firms have formed technologies, techniques and production systems with totally independent intellectual property rights.

The firm only learnt from media reports that Metglas and Hitachi had lodged a Section 337 complaint with the US International Trade Commission accusing several Chinese companies, including AT&M, of infringing commercial secrets about alloy strips that are exported from, imported to or sold in the US. The Section 337 complaint falls under the Tariff Act of 1930.

AT&M hasn't received any relevant documents, the company added.

This wouldn't be the first time that AT&M locked horns with Hitachi. In 2015, the Chinese firm filed for the Ministry of Commerce to run an anti-dumping probe into the Japanese company which wound up with it having to pay an anti-dumping duty of 25.9 percent against imported amorphous alloy strips originating in Japan or the US.
